NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall be two separate but related procedural requirements for activities to be undertaken by the City of Muskegon Heights.

REQUEST FOR RELEASE OF FUNDS

On or about July 9, 2011, the City of Muskegon Heights will submit a request to the US Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended to undertake the projects listed below:

The City of Muskegon Heights is bounded by the centerline of the following streets: Getty Street to the East; Glade Street to the West; Norton Avenue to the South, except for Mona Lake from Green Street on the East to approximately Peck St on the West; Keating to the North except for Hackley Avenue from Glade Street to Park Street.

The following programs will be conducted on a city-wide basis:

1. General Administration                                                                          $84,166.20                

Overall administration and indirect costs associated with the general administration of the CDBG Program. The General Administration Budget is determined at 20% of $420,831.00. (21A-570.206)

 

2. Housing Rehabilitation Administration                                                $71,511.27                 

Overall HUD CDBG housing rehabilitation services to include quality control under the City’s housing code and HUD Section 8 HQS program standards, pre and post construction inspections, case management, construction cost estimation and project bid development and implementation. Also included are costs for the management of the Michigan State Housing Development Authority, Blight Elimination Program, NSP, and Rehabilitation Administration determined at 17% of $420,831.00.   (14H-570.202)

 

3. Community Liaison                                                                                 $25,000.00                 

To support a part-time staff person to provide technical assistance to neighborhood associations, block clubs and community based, non-profit organizations. (19c)

 

4. City-Wide Paint                                                                                        $20,000          

To provide paint and painting services for homeowners City-wide. (14A-570.202)

 

5. Substantial Rehabilitation                                                                      $20,000.00

To provide financing for the substantial rehabilitation of 3 housing units to bring the units up to City building code and HUD- HQS and Energy Star Standards. (14A-570.202)

 

6. Code Enforcement                                                                                 $7,028.53

To provide funding for inspections for the demolition of structures used for criminal activities or pose a threat to the health, safety and welfare of citizens. Priority will be given to structures on the routes to elementary schools. (15-570.202c)

 

7. Demolition                                                                                                $100,000.00

To provide demolition services for 10 single-family housing units and two commercial housing units in conjunction with MSHDA Blight Elimination Program. (04- 570.201(d))

 

8. Landlord / Tenant Rights Program                                                        $5,000.00

To provide funding for Legal Aid of Western Michigan in the provision of legal services, information, referrals and dispute resolution between landlords and tenants. (05k-570.201e)

 

9. Anti-Poverty Program                                                                              $25,000.00                 

To provide seed money to hire a consultant to develop and implement a plan which would include local community partners that will reduce poverty in the community by one percent over a five year period. (19C)

 

10.  Neighborhood Policing                                                                      $63,125.00

To develop a Neighborhood Policing Program that encourages police to proactively solve community problems and address the factors that contribute to violent neighborhood crime in US Census Tracts 14.01 and 14.02.

 

Total CDBG Application                                                                             $420,831.00

 

CDBG Budget Amendments

In accordance with 24 CFR Part 91 Subpart F Section 91.505, the City is redistributing line items funded in previous years. The funding will be distributed to the following new or existing projects:

a)     $16,000 transferred from 36th year Recreation to Fire Engine

b)     $25,000 in 36th year Community Based Organizations to Anti-Poverty

c)     $10,890 transferred from the 36th year Strand Building to the Mona Lake Park Project

 

FINDING OF NO SIGNIFICANT IMPACT

The City of Muskegon Heights has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Department of Planning and Community Development, City Hall, 2724 Peck St, Muskegon Heights, MI, 49444 and may be viewed or copied (upon request) weekdays from 8:30 A.M. to 5:00 P.M.

 

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to the Department of Planning and Community Development. All comments received by June 20 will be considered by the City of Muskegon Heights prior to authorizing submission of a request for release of funds.

RELEASE OF FUNDS

The City of Muskegon Heights certifies to HUD that Darrell L. Paige in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce the responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The U.S. Department of Housing and Urban Development's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Muskegon Heights to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of funds and the City of Muskegon Heights' certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Muskegon Heights; (b) the City of Muskegon Heights has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR part 58, Sec. 58.76) and shall be addressed to the U.S. Department of Housing and Urban Development - Detroit Field Office, Patrick V. McNamara Federal Building - 477 Michigan Ave. Room 1710, Detroit, MI 48226-2592. Potential objectors should contact HUD to verify the actual last day of the actual objection period.
